Please read these Terms of Service carefully before using the ForeBuild platform. By creating an account or accessing the service, you agree to be bound by these terms. If you do not agree, do not use ForeBuild.
These Terms of Service ("Terms") govern your access to and use of the ForeBuild platform, website, and related services (collectively, the "Service") provided by ForeBuild Pty Ltd ABN [to be inserted] ("ForeBuild", "we", "us", "our"), a company registered in New South Wales, Australia.
These Terms constitute a legally binding agreement between you (or the business you represent) and ForeBuild. If you are agreeing to these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity.
ForeBuild provides an AI-powered construction intelligence platform that aggregates and analyses publicly available development application data, industry news, and market signals, and delivers tailored intelligence to building industry suppliers and subcontractors operating in New South Wales, Australia.

You are responsible for all activity that occurs under your account. You must notify us immediately at support@forebuild.com.au if you become aware of any unauthorised use of your account.
We offer a 7-day free trial of the Service. No credit card is required to start a trial. At the end of your trial, your account will revert to a limited access state unless you upgrade to a paid subscription.
Paid subscriptions are billed monthly in advance. By subscribing, you authorise ForeBuild to charge your nominated payment method on a recurring monthly basis until you cancel. All prices are in Australian Dollars (AUD) and are inclusive of GST where applicable.
You may cancel your subscription at any time through your account settings or by contacting us at support@forebuild.com.au. Cancellation takes effect at the end of your current billing period. We do not offer partial-month refunds.
We may change subscription pricing at any time. We will provide at least 30 days' written notice before any price increase takes effect for existing subscribers.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

All content, software, algorithms, designs, trademarks, and materials comprising the ForeBuild platform are the exclusive property of ForeBuild Pty Ltd or its licensors. Nothing in these Terms grants you any ownership or licence in our intellectual property beyond the right to use the Service as described herein.
Intelligence reports, bulletins, and alerts generated by the platform are provided for your internal business use only. You may not republish, resell, or redistribute outputs from the platform without our written consent.
You retain ownership of any data or content you submit to the platform (such as research task queries). By submitting content, you grant us a limited licence to process that content for the purpose of providing the Service.
ForeBuild aggregates data from publicly available sources including NSW government planning portals, industry publications, and economic data providers. While we take reasonable care to ensure accuracy, we make no warranty that any information provided through the Service is complete, accurate, or up to date.
The Service is an intelligence tool, not professional advice. Nothing in the platform constitutes legal, financial, planning, or business advice. You should conduct your own due diligence before making business decisions based on information provided by ForeBuild.
To the maximum extent permitted by Australian law, ForeBuild provides the Service "as is" and "as available" without any warranties, express or implied. We do not warrant that:
Nothing in these Terms excludes or limits any right you may have under the Australian Consumer Law that cannot be excluded or limited.
To the maximum extent permitted by law, ForeBuild's total liability to you for any claim arising from or related to the Service is limited to the total fees you paid to us in the 3 months immediately preceding the claim.
We will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profit, loss of data, or business interruption, arising from your use of or inability to use the Service.
You agree to indemnify and hold harmless ForeBuild Pty Ltd, its directors, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses arising from your use of the Service in violation of these Terms or applicable law.
We may suspend or terminate your access to the Service immediately, without notice, if we reasonably believe you have breached these Terms or are engaged in conduct that may harm ForeBuild, other users, or third parties.
Upon termination, your right to access the Service ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will continue to apply.
These Terms are governed by the laws of New South Wales, Australia. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of New South Wales.
We may update these Terms from time to time. We will notify you of material changes by email or by notice on the platform at least 14 days before the changes take effect. Your continued use of the Service after that date constitutes acceptance of the updated Terms.
